- Billing Information: Payment and insurance billing data processed through our integrated billing services. Full payment card data is handled by PCI-compliant third-party processors and is never stored directly by imisshtml LLC.
2. How We Use Your Information

- Business Associates: With Business Associates under a signed Business Associate Agreement (BAA) as required by HIPAA when PHI is involved.
- Legal Requirements: When required to comply with applicable law, regulation, legal process, or enforceable governmental request.
- Business Transfers: In connection with a merger, acquisition, or sale of assets, where user data may be transferred as part of that transaction, subject to the same privacy commitments.
4. Data Accuracy & Retention
Personal data should be relevant to the purposes for which it is to be used and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date. We provide mechanisms within the platform for authorized users to review and update their information.

BRDS Care operates as a platform used by healthcare providers who may store and process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations.
- imisshtml LLC maintains a dedicated, on-staff HIPAA-Compliance Security Officer responsible for overseeing our HIPAA compliance program.
- We enter into Business Associate Agreements (BAAs) with covered entities using BRDS Care where applicable.
- PHI stored within the platform is protected by administrative, physical, and technical safeguards in accordance with the HIPAA Security Rule.
- Breach notification procedures are maintained in compliance with the HIPAA Breach Notification Rule.

13. Limitation of Liability
In no event shall imisshtml LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the BRDS Care platform, even if imisshtml LLC has been notified of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

This Privacy Policy and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of Florida. You irrevocably submit to the exclusive jurisdiction of the courts in that State for any claims arising under or related to this policy.
